These Terms of Service (“Terms”) govern your access to and use of the DLM Solutions Group website, storefront, and digital toolkits (collectively, the “Services”), operated by DLM Solutions Group LLC (“DLM,” “we,” “us,” or “our”). By using the Services or placing an order, you agree to these Terms.
1. Acceptance
By accessing the Services or placing an order, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 18 years old and legally able to enter contracts to place an order. By purchasing, you represent that you meet these requirements and that the information you provide is accurate.
3. Accounts
If you create an account, you are responsible for safeguarding your credentials and for activity that occurs under your account. Notify us promptly of any unauthorized access.
4. Orders & Pricing
All orders are subject to acceptance and product availability. Prices are listed in US dollars and may change without notice prior to order confirmation. We reserve the right to cancel or refund any order with a pricing or inventory error.
5. Payment
Payments are processed through Wix Payments and supported payment networks (PayPal, Visa, Mastercard, American Express). You authorize us, or our payment processor, to charge the payment method you provide for the total order amount, including any applicable taxes and shipping. Net-terms invoicing is available for approved quote-desk accounts.
6. Shipping
Shipping terms, transit times, and free-shipping thresholds are described in our Shipping Policy, which is incorporated by reference.
7. Returns
Returns and refunds are governed by our Return Policy, which is incorporated by reference.
8. Intellectual Property & Toolkit License
All content on the Services — text, graphics, logos, product imagery, and digital toolkits — is owned by DLM or its licensors and protected by US and international intellectual property law. Operator toolkits are licensed, not sold. Each toolkit purchase grants you a perpetual, non-exclusive, non-transferable, single-team license to use the toolkit internally. You may not resell, sublicense, publicly redistribute, or remove proprietary notices from the toolkit without prior written consent.
9. Acceptable Use
You agree not to misuse the Services, including by attempting to access them by means other than the published interfaces, interfering with their operation, or using them to violate any applicable law.
10. Disclaimer of Warranties
The Services are provided “as is” and “as available” without warranties of any kind, express or implied, except as required by law. Product descriptions are provided for general reference. DLM does not provide professional safety, legal, or operational advice; the Services are tools, not advice.
11. Limitation of Liability
To the maximum extent permitted by law, DLM and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services. Our aggregate liability for any claim related to the Services will not exceed the amount you paid to DLM for the product or toolkit giving rise to the claim in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless DLM, its officers, employees, and agents from any claim, liability, or expense (including reasonable attorneys’ fees) arising out of your breach of these Terms or your misuse of the Services.
13. Governing Law
These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-laws principles. The exclusive venue for any dispute is the state and federal courts located in DuPage County, Illinois.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with a new “Last updated” date. Continued use of the Services after a change constitutes acceptance of the updated Terms.
